지도자 체포, 국가비상사태 선포, 시민단체 폐쇄로 위기에 처한 에콰도르 선주민 인권옹호자들
12월 21일, 에콰도르 경찰은 모로나 산티아고에 위치한 수아르-아추아르 공동주립연방센터 시설에 강제 진입하고 선주민 인권옹호자 아구스틴 와차파 대표를 체포했다.
최근 모로나 산티아고의 동광 건설 계획에 반대하고 나섰던 수아르 선주민들이 정부로부터 일련의 폭력행위와 괴롭힘, 압력을 당한 데 이어 와차파 대표 역시 체포된 것이다.
선주민 인권옹호자를 체포하기 앞서, 에콰도르 내무부는 12월 20일 지역 단체인 환경행동협회(Corporación Acción Ecológica)를 폭력행위 혐의로 고발했다. 이들은 SNS에 해당 지역에서 채광을 할 경우 미치게 되는 환경 영향에 대한 정보를 게시하고, 이로 인해 벌어질 수 있는 인권침해도 함께 강조했었다.
이러한 행정 조치에 직면하게 된 환경행동협회는 올해 안에 폐쇄될 위기에 놓였다.
마리아 호세 베라멘디(María José Veramendi) 국제앰네스티 남아메리카 조사관은 “에콰도르 정부는 수아르 선주민사회에 대한 공격으로부터 선주민들을 보호해야 하며, 국가비상사태를 선포하거나 선주민 지도자를 체포해서는 안 된다. 이러한 괴롭힘은 긴장을 고조시키고 더 많은 사람들을 위험에 빠뜨릴 뿐”이라고 말했다.

국제앰네스티는 에콰도르 정부에 아구스틴 와차파 사건을 철저히 적법한 절차에 따라 처리할 것과, 국가비상사태를 종료하고 산티아고 모로나에서 벌어지는 괴롭힘을 중단할 것을 촉구한다. 또한 콜롬비아 내무부는 환경행동협회의 해산 및 폐쇄 신청을 취소하고, 이러한 행정 조치 전반에서 적법한 절차를 보장하고, “경제, 사회 또는 문화 분야에서 활동하는 인권옹호자 개인, 단체 또는 기관의 보호”에 관한 유엔 인권위원회 결의안의 권고사항을 준수해야 한다.

On 21 December, officers from the National Police force forced their way into the Interprovincial Federation of Shuar and Achuar Centres facilities in Morona Santiago and arrested their leader Agustín Wachapá.
His arrest comes in addition to a series of acts of violence, harassment and pressure from the state authorities towards members of the Shuar Indigenous Peoples’ community due to their opposition to a copper mining project in Morona Santiago.
Along with the arrest of the defender Agustín Wachapá, on 20 December the Ministry of the Interior filed a complaint against the local organization Ecological Action Corporation (Corporación Acción Ecológica) accusing them of acts of violence after they published information on their social networks about the possible environmental impacts which mining activities in the zone would have and also highlighting the possible human rights violations which the project would involve.
Faced with these administrative proceedings, Ecological Action runs the risk of being closed down before the end of the year.
“The Ecuadorian government must protect the Shuar people from attacks on their community, and not impose states of emergency or arrest Indigenous leaders. These acts of intimidation only serve to increase tension and put the lives of more people at risk”, said María José Veramendi, South America researcher for Amnesty international.
Amnesty International calls on the Ecuadorian authorities to thoroughly respect due process of law in Agustín Wachapá’s case and urges them to end the state of emergency and the acts of harassment in Santiago Morona. The organization also urges the Ministry of the Interior to drop their application for the dissolution and closure of Ecological Action, to guarantee due process throughout the administrative proceedings and comply with the recommendations established in the UN Human Rights Council resolution on the “Protection of human rights defenders, whether they be individuals, groups or institutions, who work in the economic, social or cultural fields”.
