오사리아키
2014년 3월 저녁 7시, 국제앰네스티 말레이시아 사무실로 한 통의 전화가 왔다.
형이 72시간 후에 사형당한다는 내용이었다!
사형수는 나이지리아 국적의 오사리아키(Osariakhi Ernest Obayangbon)였다. 그는 18년 전에 저지른 범죄로 유죄를 선고받았고 2007년 항소심이 있기 전에 정신분열을 호소해 치료를 받고 있었다.
그와 공범이라고 지목된 사람은 재심에서 혐의가 뒤집어졌는데, 판단을 하기 힘든 상태인 오사리아키는 항소심에서 관용을 호소하지도 못했다.
국제법에서는 정신적인 건강 문제를 겪는 사람에게 사형 집행하는 것을 제한한다.
오사리아키가 공정한 재판을 받았는지도 심각하게 의심됐다. 2013년, 말레이시아에서 사형선고를 받은 사람의 50% 이상이 외국인이었다. 그 중 많은 사람들의 범죄가 국제법상 “가장 심각한 범죄”에는 전혀 해당하지 않는 범죄였다.
국제앰네스티는 즉각 긴급행동에 나섰다. 72시간의 행동으로 사형집행은 시행되기 직전에 중단됐다. 사형집행 당일, 그는 이미 집행실로 가는 중이었고 집행 준비가 한창일 때 중단하라는 지시가 있던 것이다. 그로부터 3년 후, 말레이시아 왕이 오사리아키를 사형에서 종신형으로 감형하며, 그는 마침내 사형을 피하게 됐다.
긴박했던 72시간의 행동으로 한 남자가 생명을 찾은 것이다!
오사리아키의 형제 커티스(Curtis)가 이 기쁜 소식과 함께 국제앰네스티에 감사 인사를 보냈다.

오랜만에 인사드립니다. 누군가의 삶을 구하는 활동을 하시느라 바쁘시리라 생각됩니다. 국제앰네스티 활동에 경의를 표합니다.
2014년 저희 형이 사형선고를 받았을 때 무작정 국제앰네스티에 찾아가 울었던 기억이 납니다. 시간조차 우리 편이 아니었음에도 여러분은 포기하지 않았어요. 저와 만난 후에 전담팀이 꾸려졌고, 런던에 있는 헤이즐과 말레이시아의 팀이 함께 나서 형을 구해줬어요. 여러분은 저희 형만 구한 것이 아닙니다. 그가 사형당하면 의미를 잃고 산산이 조각나버릴 우리 가족 모두를 살린 것입니다.
여러분은 사형제 폐지를 위해 계속 싸웠습니다. 형이 사형에서 종신형으로 감형된 오늘 이 순간을 축하할 수 있는 것도 바로 그 노력의 결과입니다.
사람들의 목소리가 곧 신의 목소리입니다. 국제앰네스티가 사형반대에 목소리를 내왔고, 신이 그 뜻을 오사리아키에게 전해주셨습니다. 그리고 그 뜻은 전 세계에도 전해질 것입니다.
국제앰네스티가 없었으면 우리 가족은 슬픔과 눈물 속에 살고, 삶이 황폐해졌을 것입니다. 저는 분명히 아이들을 학교에 보낼 수도, 오늘처럼 웃으면서 맞이하지도 못했을 것입니다.
형 뿐만 아니라 그와 비슷한 상황에 있는 사람들에게 국제앰네스티 같은 단체가 있다는 것이 얼마나 감사한지 모릅니다. 이번 승리로 여러분은 사형 종결의 종소리를 울렸습니다. 그리고 생명을 창조하고 빼앗을 수 있는 권한은 인간이 아니라 오직 신에게만 있다는 것을 다시 한 번 일깨워줬습니다. 무엇보다 여러분은 어떤 대가도 없이 이런 훌륭한 성과를 이뤄냈습니다!
형을 대신해, 다시 한번 우리들에게 희망을 찾아주셔서 감사하다는 인사를 전합니다. 바쁘신 와중에도 신경 써주셔서 감사합니다.

Dear Shamini(Executive Director, Amnesty International Malaysia)
It has been a while! I know you are busy working for humanity and saving lives. I salute your courage and doggedness to the [cause] you have chosen.
When in 2014 Osariakhi was to be put to death, we cried to you at Amnesty International and even though time was against us, you did not give up. You put together a team from that moment that I contacted you and together with Hazel in London and your team in Malaysia, my brother’s life was saved. And you did not only save Osariakhi’s life, you restored hope to the family whose lives would have been shattered and meaningless had the execution been carried out. You did not relent after that, rather, you continued to champion the campaign for the abolition of [the] death sentence. The result of that effort is what we celebrate today; the commutation of his death sentence to life imprisonment.
The voice of the people is the voice of God. Your organisation [has] spoken against [the] death sentence and God has granted it to Osariakhi and it will be so the world over. Without your organisation, we would have been in grief and sorrow and we would have been devastated. I definitely would not have been able to send my children to school and wouldn’t be smiling back to them today. Thank God that Amnesty International exist[s] so that Osariakhi and others in similar situation might live. By this victory, you have sounded the [death] bell on (the) death sentence and you have reminded those in authority that only God can create and take [life], not humans. Above all, you achieved this[feat] without collecting a dime from us for your good work!
On behalf of Osariakhi, we wish to thank you once again for restoring hope to the hopeless and thank you for those many phone calls at odd hours which you never refused to take. We are very proud of you and your organisation and may you continue to grow from strength to strength.
