11월 29일 아제르바이잔 대법원이 정치활동가 자바 사발란(20)에게 유죄를 선고한 것에 대해 국제앰네스티는 다시 한 번 사발란의 즉각적인 석방을 요구했다.
“아제르바이잔 법원은 정치적 이익 앞에 법치(法治)는 없다는 것을 다시 한 번 보여줬다”고 존 달후이센(John Dalhuisen) 국제앰네스티 유럽중앙아시아국 부국장이 말했다.
2011년 5월 4일 자바 사발란은 반정부 시위를 요구하는 글을 페이스북에 게시한 뒤 징역 2년 6개월 형을 선고 받았다. 그는 마약 때문에 유죄 선고를 받았는데 국제앰네스티는 이 혐의가 조작된 것으로 보고 있다.
혈액 검사에서 마약의 흔적이 없었음에도 불구하고 그는 여전히 유죄인 상태다. 그에게서 발견됐다는 0.74g의 마리화나는 숨가이트 경찰서(Sumgayit)측이 미리 넣어둔 것으로 보인다.
29일 대법원에서 자바 사발란에게 유죄 판결을 내린 뒤, 그의 변호사 중 한 명인 아사발리 무스타파예브(Asabali Mustafayev)는 국제앰네스티에 “대법원이 정의를 실현해줄지도 모른다는 것에 조금이나마 희망을 걸긴 했지만, 이런 판결이 난 것이 놀랍지는 않다. 이제 우리가 할 수 있는 일은 그의 판례를 유럽인권재판소에 회부시키는 것 밖에 없다. 우리는 이 일을 가능한 한 빨리 처리할 것이다”고 말했다.
올해 3월과 4월 아제르바이잔 당국이 평화 시위를 무자비하게 진압한 이후로 현재까지 양심수 17명이 수감되어 있고, 자바 사발란은 그 중 한명이다.. 국제앰네스티는 2011 편지쓰기마라톤 캠페인에서 그를 올해의 사례중 하나로 선정해 아제르바이잔 내의 인권침해에 대한 국제적인 관심을 모으고 있다.
2011년 12월 3일부터 17일까지 전세계 수 만 명의 사람들이 국제앰네스티 편지쓰기마라톤을 통해 자바 사발란을 위해 행동하고 있다. 70개국 이상에서 그의 권리를 존중할 것을 요구하는 편지, 탄원 서명, SMS 메시지, 온라인 행동 취하기를 할 것이다.
“아제르바이잔은 올해 10월 유엔안전보장이사회에 가입했고 내년에는 매해 1억 2천 5백만 관중이 지켜보는 유로비전송 콘테스트를 주최할 것이다. 아제르바이잔에 대한 국제적인 관심이 높아지는 이 시기가 아제르바이잔 정부에는 국제인권의무를 진지하게 고려해야 할 시기다.
당국은 즉각 자바 사발란을 석방시키고 현재 수감된 양심수 16명 또한 석방 시켜야 한다”고 달후이센 부국장이 말했다.

Azerbaijan fails again to ensure justice for Jabbar Savalan
29 November 2011Amnesty International reiterates its call for the immediate release of Jabbar Savalan after today’s decision of Azerbaijan’s Supreme Court to uphold the conviction of the 20-year-old political activist.
“Azerbaijani courts have once again demonstrated that there is no rule of law in Azerbaijan when political interests are concerned” said John Dalhuisen, Deputy Director for Amnesty International’s Europe and Central Asia Programme.
On 4 May 2011, Jabbar Savalan was jailed for two and a half years after using Facebook to call for protests against the government. He was convicted on drugs charges the organization believes to have been fabricated.
Jabbar Savalan’s conviction was secured despite a blood test showing that he had not used drugs and credible allegations that the police had planted the 0.74g of marijuana they claim to have found on him at Sumgayit police station.
After today’s decision of the Supreme Court to uphold Jabbar Savalan’s verdict, Asabali Mustafayev, one of his lawyers told Amnesty International:
“We still had a little hope that the Supreme Court might deliver justice, but their decision was not surprising. Now we have no other choice but to submit his case to the European Court of Human Rights and we will do it as soon as possible.” Jabbar is one of 17 prisoners of conscience currently behind bars in Azerbaijan, after the authorities clamped down on peaceful protests in March and April 2011. Amnesty International is using his case to focus international attention on human rights abuses in Azerbaijan during its 2011 Letter Writing Marathon.
Between 3 and 17 December this year, hundreds of thousands of people around the world will be taking action on behalf of Jabbar Savalan as part of Amnesty International’s annual Letter Writing Marathon. People in over 70 countries will be writing letters, signing petitions, sending SMS messages and taking action online to demand that his rights are respected.
“Last month Azerbaijan was elected to the UN Security Council and next year will host the Eurovision song contest, watched by around 125 million people each year. As the international spotlight falls on Azerbaijan it is high time the government took its international human rights obligations seriously” said Dalhuisen.
“The authorities must immediately release Jabbar Savalan and the 16 other prisoners of conscience currently behind bars.”
