수단: 전쟁범죄 혐의자는 국제형사재판소에 회부되어야 한다
국제앰네스티는 수단 전쟁범죄 용의자들에게 구속영장을 발부하기로 한 국제형사재판소의 오늘 판결을 지지한다. 그리고 즉각 두 명의 용의자들을 체포하여 헤이그 재판소에 회부할 것을 수단 정부에 촉구한다.
현 인권부 장관 아흐마드 하런(Ahmad Harun)과 잔자위드 지도자로 유명한 알리 마흐무드 알리 압델라흐만(Ali Muhammad Ali Abdelrahman)은 50여건에 달하는 살인, 사유재산의 파괴, 약탈, 강간, 고문 등 반인도주의적 범죄 및 전쟁 범죄 혐의를 받고 있다.
‘유엔 안보리는 지금 즉시 수단을 포함 두 용의자가 있는 어느 국가이건 즉시 이들을 체포하여 인도하도록 요구해야 한다,’ 국제앰네스티 아프리카 프로그램 담당자 에르윈 반 데르 보릇(Erwin van der Borght)은 이와 같이 밝히며 ‘수단유엔파견단(UNMIS)또한 이런 책임이 있으며 그들을 체포하여 인도할 준비가 되어야 한다.’고 주장하였다.
국제앰네스티는 아프리카연합 측에 수단 정부가 두 용의자를 체포하도록 압력을 가할 것과 만일 두 용의자가 아프리카연합군 작전범위 내에서 발견될 경우 다르푸르의 그들 군대에 체포를 명할 것을 촉구한다.
또한 국제앰네스티는 수단 및 다른 정부들에 국제형사재판소 검사에 의해 기소되지 않은 반인도주의적 범죄자들을 국제 기준에 따라 수사 및 기소하고 희생자들과 가족들이 보상을 받을 수 있도록 노력할 것을 촉구한다.
알리 쿠샤이브(Ali Kushayb)는 현재 다르푸르에서 재판을 기다리며 구금되어있는 것으로 알려졌으나 수단정부가 효과적으로 그를 처벌할 능력과 의지가 있는지는 의문이다.
“국제형사재판소의 오늘 이 판결은 다르푸르에서 일어나고 있는 인권범죄에 대해 국제사회가 어떻게 대응해야 하는 지를 보여주고 있다.”라고 반 데르 보릇 (van der Borght)이 밝혔다.
“평화유지군 증강에 관한 정치적 협상만을 지속하는 것과 추가적 평화협상을 추진하는 것만으로는 다르푸르 사태를 처리하기에 역부족이다. 다르푸르 지역민들에 대한 범죄에 책임이 있는 자들을 체포하기 위한 구체적 수단이 즉각 실행되어야 한다.”
“다르푸르 지역민을 위한 법적인 해결책은 정치적 해법을 위한 지속적인 노력을 방해하지 않을 것이며 오히려 그 해법이 지속되도록 공헌할 것이다.”
Sudan: War crimes suspects must be brought before International Criminal Court
Amnesty International welcomed today’s decision by the International Criminal Court to issue arrest warrants for two suspected Sudanese war criminals, and urged the Sudanese government to immediately arrest the two men and hand them over to the Court in The Hague.
Current State Minister for Humanitarian Affairs Ahmad Harun, and renowned Janjawid leader Ali Muhammad Ali Abdelrahman (also known as Ali Kushayb), face 51 counts of alleged crimes against humanity and war crimes, including murder, persecution, the destruction of property, pillaging, rape, torture, outrages upon personal dignity and other inhumane acts.
“The UN Security Council must now demand that Sudan — or any other state in whose territory the two suspects are found — arrest and surrender them immediately,” said Erwin van der Borght, Director of Amnesty International’s Africa Programme. “The UN Mission in Sudan (UNMIS) should also be requested and equipped to arrest and surrender them.”
Amnesty International urged the African Union to press the Sudanese government to arrest and surrender the two men, and to direct their forces currently in Darfur to do the same if they are found within their sphere of operations.
In addition, Amnesty International called on the Sudanese government and on other governments to investigate and prosecute, in accordance with international standards, other war crimes and crimes against humanity not prosecuted by the ICC Prosecutor and to ensure that victims and their families are able to seek and obtain reparations.
Ali Kushayb is thought to be currently in detention in Darfur, awaiting trial. There is no confidence that the Sudanese government is able or willing to prosecute him effectively in this case.
“Today’s decision by the ICC indicates an important step forward in how the international community will deal with Sudan over the gross human rights violations taking place in Darfur,” said van der Borght.
“It is no longer seen to be enough to just conduct political negotiations over strengthening the current peacekeeping force in Darfur and try to further peace talks. Concrete steps must also be taken immediately to hold people to account for the crimes being perpetrated against the people of Darfur.”
“Seeking justice for the people of Darfur now will not hinder the continuing search for a political solution — it will only serve to make that solution, when it is found, more durable.”
