전례 없는 기후 위기에 발맞추어, 200명 이상의 선주민, 노동자, 학자, 환경 및 인권단체 대표단이 한 자리에 모였다. 이들은 기후와 인권, 인류 생존에 관한 사람들의 대회(Peoples’ Summit on Climate, Rights and Human Survival)에서 정부와 기업에 인류의 생존을 보장하도록 촉구하는 역사적인 선언문을 채택했다.
참석자들은 기후위기 해결의 중심에 사람과 인권을 두고, 연결성과 다양성을 갖춘 행동 중심의 대규모 운동을 촉발시킬 새로운 힘과 활력, 자원을 불러일으키고자 한다.
대회에 참석한 단체와 대표들은 기후변화에 더욱 강력히 대응하도록 정부와 기업에 압력을 가하고자 한다. 그 중에서도 기후 문제 관련 소송을 더욱 결연히 추진하는 한편, 금융업계의 화석 연료 투자에 문제를 제기하고, 국제인권법과 기준을 더욱 효과적으로 활용할 것이다. 또한 국가는 물론 국제적 차원에서 대단위의 대중 캠페인을 조직할 계획이다. 일련의 활동계획은 수 개월 내에 수립되어 실행될 것으로 보인다.
이번 대회는 유엔 인권사무소, 그린피스, 국제앰네스티, 국제환경법센터, 월리스 글로벌 펀드, 뉴욕대학교 법학대학 인권국제정의센터 등이 주최했다.
선언문
I. 사람과 사람, 사람과 자연이 어느 때보다 긴밀히 연결된 시대에, 우리는 인간이 자연의 일부로 번영하고, 선주민의 권리 등 인간의 권리와 자연환경이 기업의 이익보다 우선하는 세상을 꿈꾼다.
우리는 안전하고, 평등하며, 평화롭고, 정의로운 사회에서 살기를 원한다.
이러한 사회는 개인과 공동체 모두가 공정하고, 안전하며, 지속가능한 삶의 터전을 누리는 사회이자 자신의 삶에 영향을 미치는 의사결정에 직접 참여할 수 있고 정보와 사법정의에 대한 접근이 보장된 사회이다.
이러한 세상은 공유자원이 보존되고 공동체에 의해 지속가능하게 관리되는 세상이며, 각국 정부와 기업이 책임감 있게 행동하고 자신의 행동에 따른 결과를 책임지는 세상이다.
우리 앞에는 다음과 같은 시급한 과제, 기회가 놓여있다:
경제, 사회, 사법, 정치제도적 변화를 이끌어내 인간의 권리를 보호하고 형평성을 보장하는 것, 기후위기와 집단 멸종을 막아내는 것, 우리 아이들의 미래를 지키는 것, 오염을 일으키는 이들에게 책임을 묻는 것
화석연료와 지속 불가능한 사업관행을 단절시키는 것 등 우리는 기후위기의 폭력성으로 피해를 입은 이들과 기후정의를 위해 싸우는 모든 이들을 보호하고 지원하며 이들과 연대할 필요가 있다고 믿어 의심치 않는다.
II. 우리는 현시대의 인권침해, 차별, 불평등의 근간이 되는 사고방식과 행동, 권력구조가 지구를 위협하는 위기의 본질이기도 하다는 것을 알고 있다. 인권을 지키고 지구와 기후를 보존하기 위해서는 생태계를 상품처럼 대하는 일을 멈추고, 인간의 존엄과 권리가 생명의 연결고리에 의존하고 있다는 사실을 받아들여야 한다.
III. 기후정의를 이룩하기 위해 우리 모두는 기후비상사태가 현 세대와 미래세대의 생존과 환경, 모든 권리를 위협하고 있음을 인지해야 한다.
기후위기는 모두에게 영향을 미치는 전지구적인 문제다. 한편 이미 인권침해와 다중의 상호교차적인 차별을 겪고 있는 취약한 개인, 집단 그리고 공동체에게는 더 큰 영향을 미치고 있다. 우리는 이 역시 인지해야 한다.
기후위기는 또한 모든 국가에 동일하게 영향을 미치지 않는다. 기후위기는 분쟁과 정치적 불안, 식량안보위기, 이주 및 이재민의 증가를 야기한다. 우리는 기후이상과 환경보호를 핑계삼아 인권을 침해하는 각국 정부와 반인권 조직들에 저항하여야 한다.
IV. 우리는 기후변화에 적절한 조치를 취하지 않은 각국 정부, 특히나 대다수의 자원을 통제하고 있어 이 위기에 가장 큰 책임이 있는 정부의 패착을 규탄한다. 이는 각국 정부가 인권과 관련된 의무를 이행하고 있지 않음을 보여준다. 비슷한 맥락에서, 정부는 국내외 기후변화 악영향에 대한 탄력성을 강화하기 위해 실질적인 조치를 충분히 취하지 않았다. 그로 인해 경제력이 부족하고 소외된 이들의 상황 대응력은 낮아지고 있고, 피해는 더욱 영구화되고 있다.
V. 우리는 각국 정부가 잘못 구축한 기후 정책, 조치를 지속적으로 시행‧홍보해 생길 수 있는 인권 침해를 우려한다. 이는 기후위기에 가장 적은 책임이 있음에도 가장 큰 영향을 받는 취약한 개인 및 공동체의 희생을 담보하는 것이다.
허술하게 계획된 부적절한 기후 대책은 지속적인 탄소 배출과, 화석연료에 의존하는 경제 흐름을 굳힌다. 또한 사람들을 위험으로 내모는 그릇된 해결책을 도출하는 것으로 이어질 수 있다. 이는 인간의 권리, 특히 선주민들과 이미 차별 받고 있는 이들의 권리에 악영향을 끼친다.
VI. 각국 정부는 기업이 일으킨 영구적 기후변화를 방관해왔다. 정부는 법적인 책임이 있음에도, 기후변화와 관련된 기업의 활동을 규제하거나 인권침해와 환경파괴에 대한 책임을 기업에 제대로 부과하지 못했다. 실제로 여러 정부가 기후를 파괴하는 기업들에게 특권과 이익, 면책을 주는 정책과 무역투자조약 등을 지원하고 있다.
VII. 우리는 화석연료산업, 대규모 농산업과 같은 특정 산업체, 그리고 이들을 지원하는 금융투자자들이 기후 파괴의 주범임을 인정한다. 이러한 산업체들은 인권을 존중할 책임을 의도적으로 무시하며, 나아가 여성, 선주민, 지역사회, 그리고 다른 취약계층의 권리 침해에 기여하고 전지구적 생태계 파괴에 기여하였다.
특히 화석연료기업들은 자신의 제품이 가져올 피해를 수십 년 전부터 인식하고 있었음에도 투자자들, 대중, 지역사회를 포함한 이해관계자들에게 아무런 경고도 하지 않았다. 이와 동시에 기업들은 기후변화를 부인하거나 잘못된 정보를 퍼트리는 정교한 캠페인을 진행해 왔다.
VIII. 우리는 각국 정부가 기후위기에 적절히 대응할 인권 의무가 있음을 다시 한 번 강조한다. 이러한 대응 가운데 기후변화에 가장 취약하고 가장 많은 영향을 받는 공동체를 변화의 주체로 인식하고 우선시하여야 한다. 이를 충족시키는 것이야 말로 기후정의로 가는, 보다 효과적이고 지속가능한, 공정한 행동이다.
IX. 우리는 완화와 적응을 근간으로 하는 전통적 지식과 과학 그리고 피해와 손실의 보상에 집중한 기후인권정책이 더욱 효과적이고 공정한 대응을 이끌어낼 것임을 알고 있다. 이는 더 큰 포부를 가진 기후변화 대책을 세우는 결과로 이어질 것이다.
X. 우리는 환경인권옹호자들을 대상으로 한 살인, 젠더 기반 폭력, 위협, 괴롭힘, 환경인권옹호자에 대한 범죄화가 전세계적으로 증가하고 있다는 사실과 다수의 가해자가 처벌 받지 않고 있다는 사실에 크게 우려하고 있다. 우리는 그 중에서도 특히 여성, 선주민 인권옹호자, 취약한 옹호자 및 공동체 등 다중의 상호교차적인 차별을 마주하고 있고 젠더, 인종 혹은 다른 이유로 공격과 제재의 위협을 가장 많이 받고 있는 이들에게 집중한다.
우리는 기후대책을 요구하며 평화적 시위와 시민불복종에 참여하는 모든 이들을 부당한 억압과 박해로부터 보호할 것이다. 우리는 지속가능한 개발을 위한 정책 강화, 권리 쟁취, 캠페인 실행 과정에서 환경인권옹호자들이 중대한 역할을 하고 있음을 인정할 것을 요구한다.
XI. 기후위기는 해결가능하며, 꼭 해결해야 하는 문제이다. 다수의 효과 있는 정책과 기술적인 해결방안은 이미 알려져 있고 준비되어 있으며, 즉각적으로 시행할 수 있다. 정부와 기업은 기후변화의 동인을 해결하고 무력화할 1차적 책임이 있으며 공동체를 지속가능하고 변화에 유연하고 탄력성 있게 만들 책임이 있다.
우리는 역사상 가장 힘차고, 다양한, 단결된 사람들의 운동을 조직하는데 모든 힘을 쏟을 것이다. 진정성 있고 혁신적인 기후대책은 시민사회와 대중의 적극적인 참여 없이는 불가능할 것이다.
기후정의를 이룩하기 위해 여기 모인 우리는 다음과 같은 사항에 동의한다.
1. 우리는 인권이 기후 관련 액티비즘의 중심 가치가 될 수 있도록 더 큰 노력을 기울일 것이다. 우리는 선주민, 청소년, 여성, 빈곤층, 장애인, 어민, 소작농, 유목민, 지역 공동체, 노동자, 그 외 기후변화에 더 큰 영향을 받는 모든 집단이 기후정의를 요구하며 지구의 파괴에 저항할 때, 이들의 뒤를 따를 것이다.
2. 우리는 기후이상으로부터 인간, 생태계, 생물다양성을 보호할 것이다. 그를 위하여 즉각적이고, 대담하게, 사람이 중심이 되며 인권을 기반으로 한 전례 없는 수준의 온실가스배출 저감 조치를 요구할 것이다. 위와 같은 조치는 결국 우리 삶의 모든 불평등을 해결할 경제, 사회, 정치 제도의 대대적인 변화를 필요로 한다.
이 변화에는 공정한 자원의 분배, 특히 특권층의 불필요한 자원 소비를 줄이는 것 등이 포함되어 있다. 과감하고 신속한 방법을 통해 전 세계적으로 탄소배출을 감소시키고 화석연료 없는 미래로 나아가는 것은 이제 불가피해졌다. 이는 이미 인권 침해를 일으키는 지구 온난화로 생긴 기온상승을 섭씨 1.5도 이하의, 가능한 한 가장 낮은 수준으로 유지하기 위함이다.
3. 우리는 모든 정부의 기후정책 및 조치, 행동이 인권을 존중, 보호하고 충족할 것을 요구할 것이다. 여기에는 사람들의 알 권리, 의미 있는 수준의 기후 정책 결정 참여권을 포함한다. 또한 우리는 기업들이 상품의 공급 과정에서 인권 존중의 의무를 다할 것을 촉구할 것이다. 우리는 인권을 희생양으로 삼거나 불평등을 심화시키고, 빈곤과 기아, 약탈과 경제 · 사회 · 정치적 배제를 야기할 수 있는 모든 기후변화 대응 정책 및 조치에 반대한다.
4. 우리는 모든 가용 자원을 동원하여, 기후변화에 가장 큰 책임이 있는 국가와 기업을 더 강하게 압박할 것이다. 우리는 모든 국가들이 인권을 수호하는 선에서 과학에 근거한 배출감소목표를 신속하게 설정하고 실행할 것을, 이를 일정에 맞춰 혹은 그보다 앞서 달성할 것을 요구할 것이다.
우리는 고배출 국가가 자원이 적은 저배출 국가에게, 혹은 기업과 특권층이 소외계층에게 배출 감소의 책임과 부담을 전가하려는 시도에 반대할 것이다. 우리는 기후위기에 더 많은 책임이 있는 주체들이 스스로 책임을 인정하고 타당한 조치를 취할 수 있도록 압박할 것이다.
5. 우리는 글로벌 사우스(Global South) 국가들이 큰 포부를 가지고 기후변화에 대응하는 행동을 할 수 있도록 기후파괴에 가장 큰 책임이 있는 부유한 국가들이 자본과 기술력을 제공할 것을 요구할 것이다. 우리는 기후변화에 영향을 받은 공동체와 개인이 입은 피해와 손실에 대해,이 문제에 책임이 있는 국가들이 충분한 협의 하에, 개인과 공동체의 관습과 권리를 존중하는 방식으로 보상 등의 적절한 조치를 취할 것을 요구한다. 이러한 지원에 있어서 우리는 투명성과 자원의 올바른 사용을 장려하는 한편 추가적인 경제적 부담 혹은 채무의 발생을 반대할 것이다.
6. 우리는 기업이 정책과 기관에 미치는 영향력에 끊임없이 저항하고 기후를 파괴하는 산업체와 이들을 지원하는 금융투자자들에게도 책임을 물을 것이다.
7. 우리는 화석연료에서 지속가능한 농업과 재생가능한 에너지로 전환되는 과정이 정의롭고, 공정하면서 어느 누구도 배제하지 않기를 요구할 것이다. 이 과정에서 선주민, 노동자, 소작농, 유목민, 어민 그리고 지역공동체가 소외돼서는 안 되며, 더 큰 영향력을 행사할 수 있어야 한다. 우리는 모든 사람들, 특히 차별을 당하는 이들이 기후변화 관련 교육과 자료, 훈련, 지식을 얻을 수 있으며, 사람을 중심으로 이뤄지는 적응력 강한 무탄소사회의 밑바탕이 되는 양질의 일자리에 접근할 수 있도록 하는 방안을 모색할 것이다.
8. 우리는 선대로부터 내려오는 토지와 영토에 관한 권리 등 선주민의 권리가 존중, 보호, 충족될 수 있도록 노력할 것이다. 우리는 기후위기를 해결하기 적합하며, 식량체계의 신속한 전환을 가능하게 하고 적응력 강화에 필요한 지역별 전통 지식을 인정하고, 보존하고, 널리 알릴 것이다. 또한 이는 항상 선주민의 동의에 기반해 이들에게 이익이 되는 방식으로 진행할 것이다.
9. 우리는 기후변화 혹은 기후대책의 부족 때문에 발생한 손실과 피해 등으로 영향을 받은 개인과 공동체, 그리고 권리를 위협받고 있는 기후관련 이재민들에게 효과적이고 적합한 사법정의적 구제를 요구한다. 우리는 이들이 사법정의를 쟁취할 수 있도록 효과적인 구제책 마련과 책임자 처벌을 위해 노력할 것이다. 우리는 (정부가) 인권을 보장하고 책임의무를 다하며 기후정의를 이룩하도록 국가, 국제, 지역인권조약 및 법적 절차를 적극적으로 활용할 것이다.
10. 우리는 개인과 공동체의 영토, 토지권, 삶의 터전, 환경을 지켜내고 기후이상과 각종 파괴적인 행위로부터 지구와 사람들을 보호하는 캠페인을 진행하는 환경인권옹호자들을 지지할 것이다.
우리는 이들이 안전하게 활동할 수 있는 환경을 요구한다. 특히 다중의 상호교차적인 차별과 불평등을 겪고 있는 이들이 처벌 보복, 협박의 위험에서 벗어나 실질적인 보호 아래 인권보호와 증진활동에 매진할 수 있는 환경을 요구한다.

I – We envisage a world where people thrive as part of nature and where human rights – including the rights of Indigenous Peoples – and the environment come before corporate profit, in an era in which people are more connected with each other and with the planet. We want to live in safe, equal, peaceful and just societies. In societies where every individual and all communities enjoy fair, secure and sustainable livelihoods; participate in decision-making on matters that affect their lives; and have access to information and justice. In a world where the commons are protected and sustainably managed by communities, and where governments and corporations act responsibly and are accountable for the consequences of their actions. We see the opportunity and urgent need to transform our economic, social, legal and political systems to ensure equity and the protection of human rights, to halt the climate crisis and mass extinctions, to protect our children’s future, to hold polluters accountable for their actions, and to make fossil fuels and all unsustainable business practices a relic of the past. We believe that this vision requires protecting, supporting and being in solidarity with those who are suffering from the violence of the climate crisis and those fighting for climate justice.
II – We recognize that current human rights violations, discrimination, and inequalities find their roots in behaviours, mindsets, and power structures that are also at the core of the crisis threatening our planet. Protecting human rights and preserving our planet and its climate requires that we stop treating ecosystems as commodities and embrace the fact that human dignity and human rights depend on the web of life.
III – To achieve climate justice, we must all recognize that the climate emergency threatens human survival, the environment, and the enjoyment of all human rights, for present and future generations. We must also recognize that although the climate crisis is a global problem affecting everybody, it disproportionately affects persons, groups, and peoples in vulnerable situations, who see their rights violated and who are subjected to multiple and intersecting forms of discrimination. The climate crisis also impacts countries unequally. It results in an increase in conflict and political instability, as well as food insecurity, displacement, and migration. We need to challenge States and anti-rights groups who are using the climate breakdown and the need for environmental protection as excuses to deny human rights.
IV – We condemn the failure of States to take adequate measures to mitigate climate change, in particular those States who are the most responsible for the crisis and control the most resources. This failure represents a violation of States’ human rights obligations. Similarly, the failure to take sufficient and effective measures to enhance resilience to the harms of climate change, domestically and abroad, further perpetuates these violations – particularly among those who are marginalized and have the least capacity to cope.
V – We are alarmed that States continue to adopt and promote ill-designed climate policies and actions that ultimately result in human rights violations, often at the expense of the people and communities who are already most affected by the impacts of climate change and have done the least to create the crisis. Inadequate and poorly-designed climate measures can lead to the advancement of false solutions that continue emitting carbon, perpetuate the fossil fuel-dependent economy, and expose people to risks, which impact human rights – particularly those of Indigenous Peoples and others facing discrimination.
VI – States have been complicit in the corporate perpetuation of climate change and have largely failed to regulate the actions of corporations in this matter or to ensure accountability for human rights abuses and environmental damage, despite their legal obligations to do so. Indeed, many States support policies, including trade and investment treaties, that promote and grant corporate privileges, benefits, and impunity to climate- destroying industries
VII – We acknowledge that certain businesses – particularly the fossil fuel industry and large-scale agribusiness – and their financial backers are at the core of the destruction of our climate. Many such businesses have wilfully disregarded their responsibility to respect human rights, further contributing to infringements of the human rights of women, children, Indigenous Peoples, local communities, and other disproportionately-affected groups, and to the destruction of ecosystems across the planet. In particular, the fossil fuel industry has known about the impacts of its products for decades and failed to warn some of their investors, the public, communities, and other stakeholders, while simultaneously engaging in a sophisticated campaign of climate misinformation and denial.
VIII – We reiterate that States have human rights obligations to ensure adequate responses to the climate crisis. Such responses must recognize and prioritize the most marginalized and affected communities as the drivers of change. Fulfilling these obligations is the only way to guarantee more effective, sustainable and equitable actions and a just transition towards climate justice.
IX – We also understand from traditional knowledge and science that centring mitigation, adaptation, and loss and damage climate policies on human rights contributes to more effective and just responses, all of which results in increased ambition on climate action.
X – We are extremely concerned that killings, gender-based violence, threats, harassment, and criminalization of environmental human rights defenders are escalating all over the world and often go unpunished. We pay particular attention to those who face multiple and intersecting forms of discrimination and who are most at risk of
attacks and restrictions based on gender, race, and other forms of discrimination, such as women human rights defenders, indigenous rights defenders, and other excluded and marginalized defenders and communities. We will defend all those who peacefully demonstrate and engage in acts of civil disobedience to demand climate action from undue repression and persecution. We demand the recognition of the important role of environmental human rights defenders in strengthening policy-making, accessing rights, and campaigning for sustainable development.
XI – The climate crisis can and must be addressed. An array of effective policy and technical solutions are already known, available and immediately deployable. Governments and corporations bear the primary responsibility for taking the actions that could address and reverse the drivers of climate change and build resilient, adaptable and sustainable communities. We will invigorate our existing efforts around mobilizing the most powerful, united and diverse Peoples’ movement ever assembled. Real and transformative climate action will not be possible without a fully-engaged civil society and population.
To achieve climate justice, we, the undersigned, agree to the following:
1. We will increase our efforts to place human rights at the core of climate activism. We will do so by following the lead of Indigenous Peoples, youth, women, people living in poverty, persons with disabilities, fisherfolk, peasants, pastoralists, local communities, workers, and other disproportionately-affected groups, who are leading the call for climate justice and against activities that destroy the planet.
2. We will demand immediate, bold, people-powered and human rights-consistent action of unprecedented scale to reduce greenhouse gas emissions, in order to protect people, ecosystems, and biodiversity from the climate breakdown. Such actions require transformative change of our economic, social and political systems, to address inequalities in all aspects of life. This transformative change includes the equitable distribution of resources, particularly reducing the unnecessary consumption of resources by privileged groups. It is essential that we achieve drastic and rapid reductions in emissions globally and a fossil-free future, to keep the temperature rise as low as possible and no higher than 1.5°C degrees, as current levels of warming are already resulting in human rights violations.
3. We will demand that all government climate policies, measures, and actions respect, protect and fulfil human rights – including the right of people to be fully informed and empowered to participate in a meaningful way in climate decision- making – and that corporations fulfil their responsibilities to respect human rights across their supply chains. We will oppose any policy or action taken to combat climate change or support adaptation that comes at the cost of human rights, and those that would deepen inequalities and cause impoverishment, hunger, dispossession, and economic, social and political exclusion.
4. We will increase the pressure on those countries and corporations most responsible for climate change and with the most resources available. We demand that all countries urgently establish and enforce science-based emission reduction targets compatible with the protection of human rights, and that they meet these targets on or ahead of schedule. We will oppose attempts to transfer the burden and responsibility for change from high-emitting countries to countries with fewer resources and lower historical emissions, and from corporations and privileged groups to less-privileged groups. We will compel those bearing more responsibility for the crisis to own their actions and take measures accordingly.
5. We will call upon those States with the greatest responsibility for climate damage and with the most resources to provide the necessary financial and technological resources to countries in the global south to facilitate their ambitious actions for climate change mitigation and adaptation. We demand that those States also provide adequate means – including compensation – to affected communities and individuals to address the loss and damage caused by the climate crisis, in full consultation with them and respecting their individual and collective customs and rights. We will promote transparency and adequate use of those resources and will oppose the creation of additional financial burdens and debts as a result of this support.
6. We will relentlessly challenge corporate capture of policies and institutions, and we will hold accountable climate destructive industries and their financial backers.
7. We will demand a just, fair and inclusive transition away from fossil fuels and towards sustainable agriculture and renewable energy that empower Indigenous Peoples, workers, peasant farmers, pastoralists, fisherfolk, and communities, rather than disenfranchise them. We will seek measures to ensure that all people, particularly those facing discrimination, have access to climate education and to the resources, training, knowledge, and decent jobs required for a people-powered transition to a decarbonized and resilient society.
8. We will work for the protection, respect, and fulfilment of the rights of Indigenous Peoples, including to their ancestral lands and territories. We will seek the protection, recognition, and promotion of local and traditional knowledge that has proven effective and appropriate in addressing the climate crisis as well as enabling the transition and resilience so urgently needed in our food systems, always with the consent of, and for the benefit of, Indigenous Peoples.
9. We will demand effective and adequate access to justice for individuals and communities whose rights are impacted by the climate crisis or lack of climate action – including those facing climate-induced loss and damage and those whose rights are threatened due to climate-related displacement. We will work to ensure that they are able to enjoy access to justice and effective remedies and that those responsible for climate harms are held to account. We will proactively use national, regional and international human rights bodies and legal instruments to ensure that human rights and obligations are effectively upheld to promote climate justice.
10. We will support all environmental human rights defenders, in particular those who individually and collectively protect their territory, access to land, livelihoods, and the environment, and those campaigning to defend the people and the planet from destructive activities and climate breakdown. We will demand a safe and enabling environment in which all human rights defenders, particularly those facing multiple and intersecting forms of discrimination and inequality, are effectively protected and able to defend and promote human rights without fear of punishment, reprisal, or intimidation.
