로마족이라는 이유로 제대로 된 보상없이 강제퇴거를 당한 것도 억울한데, 쓰레기장 근처로 이주해 살아야만 했던 루마니아 클루지나포카 지역의 로마족을 위해 수많은 회원님들이 탄원편지를 보내주셨습니다.
그리고 얼마 전 루마니아 클루지나포카 지방법원은 이러한 강제퇴거 결정이 불법이라고 판결했습니다. 클루지나포카 지방법원은 로마족이 강제퇴거를 당하고 파타랏 지역으로 이주해야 했던 점과, 이 지역의 주거 환경이 적절하지 못해 입은 피해를 로마족에게 보상하라고 시 당국에 명령했습니다. 또한 루마니아 법이 정한 최소 기준에 따라 원고에게 적당한 주거지를 제공할 것을 요청했습니다.

그러나 아직 문제가 끝난 것은 아닙니다. 국제앰네스티는 이번 판결을 환영하지만, 로마족 주민들이 파타랏 지역에서 살게 된 지 4년째가 되었다는 사실은 여전합니다. 강제퇴거를 당한 주민들은 여전히 오염되고, 밀집도가 높고 위험한 환경에서 살아가고 있습니다. 시 당국은 즉시 이번 판결에 따라 조치를 취해야만 합니다. 또한 로마족을 대상으로 한 모든 강제퇴거 조치가 중단되어야만 합니다.
전 세계 도처에서 로마족이라는 이유만으로 차별받는 이 문제에 대해 앞으로도 지속적인 관심을 부탁드립니다.
루마니아 법원, ‘클루지나포카의 로마족 강제퇴거는 불법’ 판결

루마니아의 클루지나포카 지방법원은 지난 2010년 10월 300여명의 로마족을 쓰레기장 근처 부지로 강제 퇴거시켰던 당시 클루지나포카 시장의 결정이 불법이라고 판결했다. 이에 대해 유럽로마권리센터(ERRC)와 국제앰네스티는 환영의 뜻을 밝혔다.
클루지나포카 지방법원은 로마족이 강제퇴거를 당하고 파타랏(Pata-Rât) 지역으로 이주해야 했던 점과, 이 지역의 주거지 환경이 적절하지 못한 점으로 인해 입은 피해를 로마족 소송참가자들에게 보상하라고 시 당국에 명령했다. 또한 루마니아 법이 정한 최소 기준에 따라 원고에게 적당한 주거지를 제공할 것을 요청했다. 이 판결은 아직 확정되지 않았다.
ERRC는 지역 로펌인 포다루 부시우먼 어소시에이트(Podaru, Buciuman and Associates)를 선임하여, 약 200여명의 로마족 소송 참가자들을 대표해 소송을 진행했다. 이에 앞서서는 로마족의 권리 투쟁을 위한 연합 결성을 지원하기도 했다.
플로린 스탠쿠(Florin Stancu) 코아스테이 로마족 연합 대표는 “코아스테이 강제퇴거 주민들을 대표하는 조직의 대표로서, 루마니아 법원이 정치적 입장만을 고려하지 않고 증거를 조사한 점에 대해 감사를 표한다”고 밝혔다.
코아스테이 로마족 연합의 회원이자 로마족 인권활동가이기도 한 클라우디아 그레타(Claudia Greta)는 “우리가 투쟁을 시작한 지 3년이 지난 만큼 이번 판결은 아주 중요한 의미를 지닌다. 마침내 우리에게 유리한 결과를 얻게 되었으며 루마니아의 재판이 공정할 수 있음을 알게 된 것이다. 우리는 강제퇴거로 인해 큰 정신적 충격을 입었지만, 이번 판결로 2010년 12월 침해당한 우리의 권리를 계속해서 지켜나갈 힘을 얻었다. 우리가 속한 도시로 다시 돌아갈 수 있을 때까지 투쟁을 계속할 것”이라고 말했다.
ERRC와 국제앰네스티는 이제 클루지나포카 시 당국에 법원의 명령을 긴급한 사안으로써 시행하도록 촉구하고 있다.
데지데리우 저즐리(Dezideriu Gergely) ERRC 대표는 “이번 강제퇴거가 불법이라는 법원의 판결을 환영한다”고 밝혔다. 저즐리 대표는 또 “파타랏 지역으로 강제퇴거를 당한 로마족은 말 그대로 쓰레기장의 변두리에서 3년을 보냈으며 학교, 직장, 의료 서비스에 접근하기도 매우 어려웠다. 시 당국은 이 정당한 판결에 항소하지 말고, 로마족이 도시의 일원으로 살아가고 일할 수 있도록 적절한 주거 대안을 마련하고 로마족 사람들과 대화에 임해 주기를 바란다”고 말했다.
ERRC와 국제앰네스티는 이번 판결을 환영하고 있지만, 코아스테이 로마족 주민들이 파타랏 지역에서 살게 된 지 4년째가 된다는 사실은 여전하다. 강제퇴거를 당한 주민들은 여전히 오염되고, 과밀되고 위험한 환경에서 살아가고 있다. 시 당국은 즉시 이번 판결에 따라 조치를 취해야만 한다.
제제르카 티가니(Jezerca Tigani) 국제앰네스티 유럽-중앙아시아 부국장은 “클루지나포카 법원의 이번 판결은 루마니아의 지역당국들에게 부적절한 주거환경으로의 강제퇴거와 강제이주는 용납될 수 없다는 강력한 메시지를 전하고 있다. 또한 루마니아 정부에게도 강제퇴거를 명확히 규제하는 법안 마련이 필요하다는 메시지를 전하는 것”이라고 밝혔다.
이러한 상황은 파타랏 지역에서만 벌어진 것이 아니며, 루마니아 전역의 로마족에게 영향을 미치고 있는 걱정스러운 추세를 보여주는 것이다. 최근 2013년 9월 에포리에수드에서는 55명의 어린이를 포함한 로마족 주민 101명이 건축 허가를 받지 않았다는 명목으로 집을 철거당하고 혹독한 날씨 속에 거리로 나앉아야 했다. 현재 사법심사를 기다리고 있는 강제퇴거 조치를 막기 위한 어떠한 대책도 소용이 없었다.
ERRC와 국제앰네스티는 코아스테이의 불법 강제퇴거에 관한 법원의 판결을 주목하고, 이런 식의 로마족을 대상으로 한 모든 강제퇴거 조치를 중단할 것을 루마니아의 모든 지역당국에 촉구했다.

The European Roma Rights Centre (ERRC) and Amnesty International welcome the decision of the Cluj-Napoca County Court (Tribunal) that the Mayor’s decision to forcibly evict around 300 Roma in December 2010, to a site adjacent to a waste dump, was illegal.
The court ordered the city authorities to pay damages to the Romani applicants for their eviction and relocation to Pata-Rât, and for the inadequate conditions of that housing. The Court also required the city to provide the applicants with adequate housing in line with the minimum standards set out in Romanian law. The decision is not final.
The ERRC supported a local law firm, Podaru, Buciuman and Associates, to take the case on behalf of approximately 200 Romani applicants, and previously helped the community to set up an association to fight for their rights.
“As director of the association that represents the interests of the evicted community from Coastei, I express my gratitude to the Romanian justice system because they examined the evidence and didn’t just consider political interests,” said Florin Stancu Executive Director, Community Association of Roma from Coastei.
Claudia Greta is a Roma rights activist and member of the Community Association of Roma from Coastei. She said, “This decision is very important as we have been continuously fighting for three years now. We finally got a favourable result and we see that justice can be fair in Romania. Despite the traumatic effect of the eviction, this judgment gives us the strength to continue advocating for our rights, which were violated in December 2010. We will keep fighting until we can return to the city, where we belong.”
The ERRC and Amnesty International are now calling on the city authorities to implement the judgment as a matter of urgency.
“We welcome the court’s decision that this forced eviction was illegal,” said Dezideriu Gergely, executive director of the ERRC. “The Roma evicted to Pata-Rât have spent three years pushed literally to the edge of a waste dump, finding it much harder to access school, work and healthcare. We ask the authorities not to appeal this sound decision, to find alternative suitable housing and to engage in dialogue with the community, allowing the Roma to live and work as part of the city”.
While the ERRC and Amnesty International welcome the decision, the fact remains that the Coastei Street community is starting its fourth year living in Pata-Rât. The evicted families continue to live in polluted, overcrowded and dangerous conditions. It is imperative that the local authorities act on this judgment immediately.
“The decision of the Cluj-Napoca County Court sends a strong signal to the local authorities throughout Romania, that forced evictions and relocations of people into inadequate housing conditions is unacceptable. It also sends a signal to the government of Romania that there is a need to adopt regulation that would clearly outlaw forced evictions,” said Jezerca Tigani, the deputy director of Europe and Central Asia Programme of Amnesty International.
The situation in Pata-Rât is not unique, and reflects a worrying trend affecting Roma across Romania. As recently as September 2013 in Eforie Sud, 101 people, including 55 children, were made homeless in severe weather conditions after their houses were demolished ostensibly due to lack of building permits. No remedy was made available to suspend the eviction, pending judicial review.
The ERRC and Amnesty International call on all Romanian authorities to take note of the decision of the Court in relation to the illegal eviction from Coastei Street and to cease all evictions which target Romani communities in this way.
