미국 미주리주에서 비무장 상태였던 10대 소년이 경찰의 총에 맞아 숨진 사건에 대해 모든 의혹을 신속, 철저하고 독립적으로 공정하게 조사해야 함은 물론, 이번 총격 사건을 계기로 연이어 계속되는 시위를 지나치게 강경한 수단으로 진압하고 있는 점에 대해서도 지체 없이 조사가 이루어져야 할 것이라고 국제앰네스티가 밝혔다.
에리카 게바라 로사스(Erika Guevara Rosas) 국제앰네스티 미국지부 사무국장은 “현재 가장 시급한 것은 마이클 브라운의 총격 사망 사건 이후 극도로 긴장된 상황을 더욱 악화시키는 것이 아니라, 철저한 조사를 진행하는 것”이라며 “불법행위를 저지른 혐의를 받은 경찰관은 모두 실질적인 조사와, 필요한 경우에는 기소를 통해 재판에 회부되어야 한다”고 밝혔다.
로사스 사무국장은 또 “시위 진압에 과도한 무력을 동원하는 것은 용납할 수 없는 일이다. 퍼거슨 경찰은 미국 헌법 및 무력과 화기 사용에 관한 국제기준에 따라야 한다. 시민들은 표현의 자유를 평화적으로 행사할 수 있어야 하고, 기자들은 자신의 업무 수행을 방해 받지 말아야 한다”고 밝혔다.
이러한 요청은 지난밤 세인트루이스 교외의 퍼거슨에서 시위가 벌어지자 이를 해산하기 위해 경찰이 또다시 최루탄과 고무탄을 발사한 데 따른 것이다. 퍼거슨은 지난 8월 9일 비무장상태였던 10대 흑인 소년 마이클 브라운이 경찰관에게 총격을 당해 숨진 사건이 발생했던 지역이다. 언론 보도에 따르면 지난밤 시위로 최소 10명이 체포되었으며 이들 중 두 명은 기자로, 당일 오후 시위 현장을 취재하고 있었다.
8월 13일, 국제앰네스티 미국지부는 미주리주 퍼거슨 경찰서에 마이클 브라운 사망사건과 이에 항의하며 8월 11일 저녁 열린 시위 현장에서 최루탄과 고무탄을 사용한 것에 대해 깊은 우려를 표하는 서신을 전달했다.
무력과 화기 사용에 관한 국제기준은 경찰이 무력에 의지하기 이전에 비폭력적 수단을 사용해야 한다고 명시하고 있다. 목숨을 빼앗을 수도 있는 화기를 의도적으로 사용하는 것은 생명을 보호하기 위해 피할 수 없는 경우에만 허용된다.
USA: Urgently investigate policing methods after use of lethal force in Missouri
In addition to a prompt, thorough, independent and impartial investigation into allegations that police shot dead an unarmed teenager in Missouri, an investigation into the use of heavy-handed tactics to disperse a wave of protests in the wake of the shooting must be launched without delay, Amnesty International said.
“What is now urgently needed are thorough investigations, not further inflammation, of the incredibly tense situation in the aftermath of Michael Brown being shot dead,” said Erika Guevara Rosas, Americas Director at Amnesty International.
“Any police officer suspected of having committed unlawful acts must be held to account through effective investigation and, where warranted, prosecution.
“Using excessive force to quell protests is unacceptable. Police in Ferguson must conform to the US Constitution and international standards on the use of force and firearms. Residents must be allowed to peacefully exercise their right to freedom of expression and journalists must not be prevented from carrying out their work.”
The call comes after police last night again used tear gas and rubber bullets to disperse a demonstration in Ferguson, the St Louis suburb where an unarmed African-American teenager, Michael Brown, was shot dead by a police officer on 9 August. According to media reports, police arrested at least 10 people during last night’s protest, as well as two journalists who were covering the story yesterday afternoon.
On 13 August, Amnesty International USA wrote to the Ferguson Police Department in Missouri to express its deep concern over the shooting of Michael Brown and the use of tear gas and rubber bullets at a demonstration against his death on the evening of 11 August.
International standards on the use of force and firearms require that police should apply non-violent means before resorting to the use of force. The intentional lethal use of firearms is only permissible if strictly unavoidable in order to protect life.
