10월 1일, 우크라이나 도네츠크에서 학교와 버스에 포탄이 떨어져 민간인 9명 이상이 목숨을 잃은 가운데 우크라이나 정부군과 반군은 즉시 주거구역에 대한 무차별적 공격을 중단해야 할 것이라고 국제앰네스티가 밝혔다.
도네츠크 시 키예프스키에서 벌어진 이번 포격은 지난 10일간 국제앰네스티가 기록한 정부군의 무차별 폭격 및 로켓포 공격과 같은 양식으로 이루어진 것이다.
존 달후이센(John Dalhuisen) 국제앰네스티 유럽중앙아시아 국장은 “우크라이나 정부군은 도네츠크의 주거 구역에 대한 포격을 즉시 중단해야 한다”며 “정부군과 반군 모두 전투병을 대상으로만 공격해야 한다는 사실에도 불구하고 무차별적인 공격으로 민간인들을 위험에 빠뜨리며 국제인도법을 위반하고 있다. 이러한 공격은 정부군이 민간인과 전투 표적을 정확히 구분해서 조준하기 어려운 주거 구역에서 무기를 사용한 것이므로 불법적인 공격”이라고 말했다.
이날 공격으로 지난 9월 초 정부군과 친러시아 분리주의자간 휴전이 선언된 이후 하루에 가장 많은 민간인들이 희생되었다.
이 날 어린이 50여명이 등교한 학교에 포탄이 떨어지면서 민간인 4명이 사망했다. 이 날은 무력 분쟁으로 한 달간 휴교했던 도네츠크 일대 학교들이 일제히 개학하는 날이었다.
또한 소형 버스가 로켓포 또는 박격포 공격을 받아 5명이 숨졌다.
이번 공격이 이루어진 키예프스키는 지난 26일에도 공격을 받아 민간인 6명이 사망했던 바 있다.
지난 27일 키예프스키의 피해 지역을 방문했던 국제앰네스티 대표는 민간 주택으로부터 불과 10미터도 떨어지지 않은 주거지역의 거리 한복판에서 반군이 사용한 거대 대포 파편을 발견했다.
존 달후이센 국장은 “반군 역시 군사적 표적을 주거 구역에 위치시키면서 민간인을 보호하기 위해 실행 가능한 모든 조치를 취하지 못하고, 민간인을 위험에 처하게 함으로써 전쟁법을 위반한 것”이라며 “반군도 주변 지역에서 군사작전을 수행하고 있는 만큼 이번 정부군의 공격에 대한 책임을 함께 공유한다”고 말했다.
도네츠크 공항을 둘러싸고 위치한 키예프스키의 대규모 주거지역에서도 같은 날 지방의회 건물과 수많은 주택이 포격을 당한 것으로 전해져, 민간인 피해자가 알려진 것보다 훨씬 많을 것으로 우려되고 있다.
양측 분쟁당사자들이 사용하고 있는 그래드 로켓포는 표적을 정확하게 맞추지 못하는 것으로 악명이 높으며 민간 구역에서는 사용하지 말아야 할 무기다.
양측 모두 주거지역에 대한 무차별적 공격으로 민간인의 사망과 부상을 야기하고 주택을 파괴한 책임이 있다.
지난 10일간 국제앰네스티는 도네스크 북서쪽 드발체프와 도네츠크 공항 북쪽 아우지우카 등지의 민간 구역에 반군이 무차별적으로 공격을 가했다는 증거를 입수할 수 있었다.
존 달후이센 국장은 “주거 구역을 대상으로 비유도 로켓과 박격포와 같은 무차별적 무기를 사용하는 것은 국제인도법 위반이며 전쟁범죄에 해당할 수도 있다”며 “분쟁의 모든 당사자들은 전투의 수단과 방법을 선택하는 데 있어 가능한 한 전투를 피하고, 이에 따르는 민간인 희생자와 부상자, 민간 피해를 최소화할 수 있도록 모든 사전 대책을 취해야 한다”고 밝혔다.
Ukraine: Forces must stop firing on civilians after nine killed in Donetsk
Ukrainian and rebel forces must immediately end indiscriminate attacks in residential areas, Amnesty International said today after at least nine civilians were killed in strikes on a school and a bus in Donetsk.
The latest attacks, which took place in the Kievskiy district of the city, came as Amnesty International documented a pattern of indiscriminate shelling and rocket attacks in the area by Ukrainian forces in the past 10 days.
“Ukrainian government forces must immediately stop firing on residential areas in Donetsk,” said John Dalhuisen, Amnesty International’s Europe and Central Asia Director.
“Ukrainian and rebel forces are violating international humanitarian law by endangering civilians with indiscriminate attacks, despite the fact that attacks may only be directed against combatants.
“These attacks are unlawful because Ukrainian forces are using weapons in populated areas that cannot be targeted with sufficient accuracy to distinguish between civilian objects and military objectives.”
Today’s attacks resulted in the highest civilian toll in a single day since a ceasefire was struck between Kiev and pro-Russian separatists in early September.
Four civilians were killed in the shelling of a school, which had more than 50 children inside at the time, on the day schools across Donetsk opened following a month-long delay due to the armed conflict.
Another five civilians were killed when a minibus was hit – either by rocket fire or a mortar.
Six civilians were killed in Kievskiy district on Sunday, all in the same area as today’s attacks.
In a visit to the affected area of Kievskiy on Monday, Amnesty International delegates saw a large rebel artillery piece sitting in the middle of a residential street, less than 10 metres from a house.
“By basing military targets in residential areas, rebel forces have failed to take all feasible precautions to protect civilians and have endangered civilians in violation of the laws of war,” said John Dalhuisen.
“By carrying out military operations in the neighbourhood, rebel forces share responsibility for these latest attacks with the Ukrainian forces.”
A local council building and numerous homes were also reportedly hit today in the Kievskiy district, a largely residential area bordering Donetsk airport. It is feared that other civilians may have been injured or killed in the attacks.
Both parties to the conflict employ Grad rockets, which are notoriously imprecise and should not be used in civilian areas.
Both sides have been responsible for a pattern of indiscriminate attacks on populated areas, killing and injuring civilians and destroying their homes.
Over the past 10 days, Amnesty International found evidence of indiscriminate attacks by rebel fighters hitting civilian areas in Debaltseve, northwest of Donetsk, and Avdiivka, just north of Donetsk airport.
“The use of indiscriminate weapons in populated areas, such as unguided rockets and mortars, violates international humanitarian law and may amount to a war crime,” said John Dalhuisen.
“All parties to a conflict must take all feasible precautions in the choice of means and methods of warfare with a view to avoiding, and in any event to minimizing, incidental loss of civilian life, injury to civilians and damage to civilian objects.”
