국제앰네스티는 미 당국이 브래들리 매닝(일병 23살, 이후 첼시 매닝으로 개명)의 재판전 구금을 철회해야 한다고 밝혔다. 현재 브래들리 매닝은 위키리크스에 군사 기밀을 제공한 혐의로 기소된 상태다.
국제앰네스티는 버락 오마바 미 대통령과 로버트 게이트국방부 장관에게 보내는 서한에서 매닝이 23시간 이상의독방 감금이나 그 밖의 불합리한 제재를 받지 않도록 할 것을 촉구했다.
국제앰네스티 수잔 리 미주국 국장은 “아직 재판을 받지 않은 상황에서 브래들리 매닝은 자신의 지위에 맞지 않고 필요치 않은 가혹한 조건에서 구금되어 있다”고 말했다.
수잔 리 국장은 “우리는 미 당국에 매닝의 처우개선을 요구한다. 국제적 기준에 따라 재판을 받지 않는 피의자는 무죄추정원칙에 따라 대우 받아야 한다” 며 “구금 중 규율을 준수하고 교도관 및 재소자 사이에서 아무런 문제도 일으키지 않았음에도 구금 등급을 낮추어 달라는 매닝의 요구는 거부됐다”고 말했다. 국제앰네스티는 지난 1월 19일 미 국방부 장관에게 보내는 편지에서 매닝의 구금 상태에 대해 처음으로 우려를 표했다.
국제앰네스티는 지금까지 여기에 대한 답변을 듣지 못했으며, 매닝의 처우는 개선되지 않았다.
브래들리 매닝(23세)은 지난해 5월 이라크에서 체포, 기밀 정보를 개인 컴퓨터로 전송해 접근권한이 없는 제 3자에게 제공한 혐의로 기소됐다.
3월에는 ‘적을 도운’ 혐의를 포함해 22개의 혐의가 추가됐다.
7월부터 그는 개인 소지품 휴대를 금지하며 글을 쓰는 것과 읽는 것이 제한 된 채23시간 독방 감금됐다.
국제앰네스티는 가족과 변호사를 대동한 면회를 포함 모든 면회가 매닝의 허리와 발목에 수갑이 채워진 채 직접 접촉할 수 없는 상태에서 이루어졌다는 것을 알게 되었다.
매닝은 ‘자살 방지 집중 감시’(Prevention of Injury, POI) 대상으로 담요와 베개를 빼앗겼고, 낮 시간 동안 5분마다 한번씩 교도관들이 수감 상황을 확인하고 있다.
매닝은 독방 안에서 운동을 할 수 없으며 야외 활동도 거의 할 수 없다. 이는 죄수에 대한 처우를 규정한 유엔의 법규에 어긋난다.
적절한 운동이 부족하고 그 밖의 제약을 가하면서 고립과 독방감금이 계속할 경우 우울증과 불안 등 심각한 정진적 장애를 유발할 수 있다.
이달 초, 매닝은 며칠 연속으로 알몸으로 잠들어야만 했다. 이러한 가혹한 조치는 매닝이 ‘자살 방지 집중 감시’대상으로 남아있게 될지도 모른다는 말을 듣고 교도관에게 몇 마디 말한 직후 뒤따른 것이다(사실상 그가 한 이야기는 만약에 자살 하려고 들었다면 속옷에 있는 고무밴드를 사용해 이미 했을 것이라는 이야기였다). 매닝은 감방에서 매일 아침 옷을 되돌려 받을 때까지 알몸으로 열중쉬어 자세를 취해야만 했고 추위에 떨어야 했던 경험을 이야기했다.
수잔 리는 “브래들리 매닝은 현재 콴티코 해군 기지 영창에서 8달 동안 최장기간 구금 및 ‘자상 방지 집중 감시’ 대상에 놓여있는 유일한 죄수다”라며 “그의 처우와 관련해 우리가 우려하고 있는 바가 다시 한번 군 정신과 의사들이 반복적으로 브래들리 매닝에게 내려진 ‘자살 방지 집중 감시’ 대상 철회를 권고하고 있음을 통해서 강조됐다”고 말했다.
FRESH CALL FOR END TO HARSH DETENTION OF WIKILEAKS SOLDIER

The US authorities must put an end to the harsh pre-trial detention conditions of Bradley Manning, the soldier accused of leaking information to Wikileaks, Amnesty International said today.
In letters to US President Barack Obama and Secretary of Defence Robert Gates, Amnesty International called for measures to ensure that the army private is no longer held in 23-hour-a-day solitary confinement and subjected to other unreasonable restrictions.
“Bradley Manning is being held in unnecessarily harsh conditions that are inconsistent with his status as an untried prisoner,” said Susan Lee, Americas programme director at Amnesty International.
“We urge the US authorities to review Bradley Manning’s situation. Under international standards, prisoners who have not yet stood trial should be treated in accordance with their right to the presumption of innocence.”
“His requests to have his custody assignment downgraded have been denied despite his reportedly presenting no problems to staff or inmates and having a clear disciplinary record while in custody.” Amnesty International first raised its concerns about the conditions of Bradley Manning’s detention in a letter to the Secretary of Defence on 19 January.
The organization has not received a reply and Private Manning’s conditions have not improved.
Bradley Manning, 23, was arrested in May 2010 in Iraq and charged with transferring classified data onto his personal computer and passing that data to an unauthorized third party.
In March 2011 an additional 22 charges were laid against him, including “aiding the enemy”.
Since July he has been confined for 23 hours a day to a small cell, with no personal possessions and with limited access to writing and reading materials.
All visits, including those with his family or lawyer, take place in a non-contact setting during which Amnesty International has been told he is shackled at the wrists and legs.
Bradley Manning continues to be subject to a Prevention of Injury (POI) classification which means he is deprived of sheets and a separate pillow and must be checked every five minutes during the day.
He is also prevented from exercising in his cell and rarely receives any outdoor exercise, contrary to United Nations rules for the treatment of prisoners.
Prolonged isolation and confinement to a small cell, with lack of adequate exercise and other restrictions, can cause severe psychological impairment, including depression and anxiety.
Earlier this month, Bradley Manning was forced to remove all clothing and to sleep naked for several consecutive days. This treatment followed shortly after he made a remark to a custody officer when he was told that he would remain under POI status (his remark was to the effect that, had he wanted to commit suicide, he could have done so using the elastic waistband of his undershorts). He has described being required to stand to attention naked and cold at his cell door each morning before his clothes were returned to him.
“Bradley Manning is the only prisoner currently at the Quantico Marine Corps Base known to have been confined to a cell under Maximum Custody/POI status for as long as eight months,” said Susan Lee
“Our concerns regarding his treatment are further heightened by the fact that military psychiatrists have repeatedly recommended that Bradley Manning be removed from POI status.”
