우크라이나 법원이 구금 중 한 학생이 사망한 것에 책임이 있는 경찰관 두 명에게 사실상 무죄 판결을 내림에 따라 18일 국제앰네스티는이번 수사에 심각한 결함이 있다고 밝혔다.
2010년 5월 17일 당시 19살이던 이호르 인디로(Ihor Indilo)는 키에프(Kyiv)에서 경찰관 두 명에게 체포돼 심문을 받던 중 두개골 골절로 인한 내부 출혈로 사망했다. 부검 결과 그가 입은 상해는 “둔기에 의한 것”으로 밝혀졌고, 경찰은 이 부상이 작은 의자에서 넘어지면서 생긴 것이라고 말했다.
키에프 법원의 항소심에서 판사는15분 만에 이호르 인디로의 죽음에 대한 추가적인 수사는 필요 하지 않다며, 사실상 경찰 측 주장을 받아들인다고 결론 내렸다.
“이호르 인디로의 죽음에 대한 검찰 및 경찰 측 설명은 앞뒤가 전혀 맞지 않는다”고 국제앰네스티 존 달후이센(John Dalhuisen) 유럽중앙아시아국 부국장이 말했다.
그는 이어 “이번 사망사건에 대한 수사는 너무도 불충분하게 이뤄졌고, 여전히 풀리지 않은 의문이 남아 있으며, 모순이 많다. 이호르 인디로 사건에서 정의가 전혀 실현되지 않았다”고 말했다.
이호르 인디로는 2010년 5월 16일 경비와 잃어버린 신분증 문제로 작은 다툼이 있어 체포되었다. 당시 스무 번 째 생일을 하루 앞둔 날이었다.
경비원이 이호르 인디로가 술에 취하지 않았다고 진술했지만, 경찰은 구금 당시 그가 술에 취해 난폭하게 굴었다고 했다.
비번이었던 경찰관 세르게이 프리호드코(Sergei Prihodko)는 오후 8시 15분경 이호르 인디로를 구금 시켰다가 그의 친구와 함께 셰브첸키브스키 경찰서로 이송했다. 그 뒤 이호르 인디로는 함께 이송된 친구 앞에서 세르게이 코바렌코(Sergei Kovalenko) 경관과 세르게이 프리호드코(Sergei Prihodko) 경관에게 심문을 받았다.
조사실로 들어간 지 몇 분 지나지 않아 이호르 인디로가 의식불명에 빠졌고, 구급차가 도착했다. 제대로 조사도 이루어지지 않은 상태였다.
9시 49분 타임코드가 찍힌 CCTV에는 구급대원들이 떠난 뒤 경찰관들이 이호르 인디로를 어느 감방으로 끌고 들어가 바닥에 놓고 나오는 장면이 포착됐다.
CCTV를 확인해 보면이호르 인디로는 밤새 상태가 악화되고 있었다. 그는 감방에 비틀거리며 들어와 쓰러졌고 새벽 3시경부터 움직임이 없었다.
경찰은 4시 51분에 그가 주검이 된 것을 발견하기 전까지 그의 상태를 확인하지 않고 내버려뒀다. 경찰은 그의 맥박과 호흡을 확인해 그가 여전히 살아있는지를 확인했다고 주장하지만, CCTV에는 한 경찰이 이호르 인디로가 사망한 것을 발견하고, 단지 그의 몸을 밀어보고 툭툭 쳐 보는 장면만 찍혀있었다.
다음 날 아침 이호르 인디로의 부모는 그가 질식사 했다는 말을 들었지만 그들이 시신을 확인했을 때 이호르 인디로의 몸은 멍 투성이였다 부검 결과 복부를 가격당해 발생한 것으로 보이는 위내 출혈이 발견됐다.
그러자 경찰은 이호르 인디로가 술에 취해 감옥 안에 있던 50cm 정도의 의자에서 넘어진 것 때문에 사망한 것이라고 주장했다. 그러나 그가 경찰서에 들어올 당시 CCTV에 찍힌 모습으로는 술에 취한 것처럼 보이지 않았다.
세르게이 프리호드코와 세르게이 코바렌코는 이호르 인디로의 죽음에 책임을 물을 말한 증거가 없다는 이유로 가벼운 근무 태만 죄를 선고 받았다.
이호르 인디로 사건을 맡은 법원에서는 더 많은 증거를 요구했었지만, 17일 항소심에서 이호르 인디로 사건에 대한 더 이상의 조사는 하지 않는다고 판결을 냈다.
“이번 조사에서는 경찰과 의료진의 행동 또는 무대응으로 사망에 이르게 되었는지에 대해서 적절히 다루지 않았다”라고 존 달후이센 부국장이 말했다.
또한 그는 “사망에 대한 증언에서 나타난 모순과 불일치를 해결하는 시도가 전혀 이뤄지지 않았다. 뿐만 아니라 그가 사망할 무렵의 CCTV 장면과 부검 결과에 대한 의학적 분석도 이뤄지지 않고 있다”고 말했다.
그는 이어 “국제앰네스티는 우크라이나 당국에 이호르 인디로의 죽음을 전면 수사 하고, 의문을 해소하라고 촉구했다”고 말했다.

18 Aug 2011An investigation into the death in custody of a Ukrainian student is seriously flawed, Amnesty International said today after a court effectively cleared two police officers of responsibility for his death.
Ihor Indilo, 19, died from a fractured skull and internal bleeding on 17 May 2010 after being arrested and interrogated by two officers in Kyiv. An autopsy revealed his injuries were caused by “contact with a blunt object”; police say these occurred when he fell off a small bench.
Judges in Kyiv’s court of appeal yesterday took 15 minutes to conclude that no further investigation was required into Ihor Indilo death, effectively accepting the police explanation.
“The explanation for Ihor Indilo’s death that has been given by the police and supported by the Prosecutor just doesn’t add up.” said John Dalhuisen, Deputy Director of Amnesty International’s Europe and Central Asia Programme.
“The totally inadequate investigation into this case has left too many questions unanswered and inconsistencies unresolved. Justice is clearly not being done in this case.”
Ihor Indilo was arrested on 16 May 2010 after a disagreement with a security guard at the dormitory where he lived about a missing ID card. He had just celebrated the eve of his 20th birthday,
Police said he was drunk and aggressive when detained, although the security guard has since testified that he was neither.
Off-duty officer Sergei Prihodko detained Ihor Indilo at about 8.15pm and drove him and a friend to Shevchenkivsky police station, where he was interrogated by Prihodko and another officer, Sergei Kovalenko, in the presence of the friend.
Minutes later, an ambulance was called to the interview room because Ihor Indilo was unconscious, although he was not thoroughly examined. CCTV footage at 9.49pm shows police officers dragging Ihor Indilo into a cell and leaving him on the floor, the ambulance crew having left.
The footage shows the student’s condition deteriorating through the night; he staggers and falls in the prison cell, until he ceases moving at around 3am.
Police left him unattended in the cell until they discovered his body at 4.51am. Officers claim they checked his pulse and breathing and that he was still alive, but the CCTV footage shows an officer simply discovering his body, dragging him and then rolling him over.
The following morning Ihor Indilo’s parents were told that he had choked to death but when they saw his body they noticed numerous bruises. The autopsy also found blood in his stomach, which may have been caused by a blow to the abdomen.
Police then claimed Ihor Indilo died as a result of falling from a 50 cm bench in the cell because he was drunk. Indilo does not appear drunk in CCTV footage of him entering the police station.
Sergei Prihodko and Sergei Kovalenko are both being tried on minor negligence charges, as they were not found to be in any way responsible for Ihor Indilo’s death.
The court taking on Indilo’s case had requested more evidence but yesterday’s appeal court verdict rules out any further investigation.
“This investigation has failed to adequately consider the extent to which the action or inaction of the police and medical staff contributed to the death of Ihor Indilo,” said John Dalhuisen.
“No attempt has been made to resolve contradictions and inconsistencies in the testimonies, nor to seek further medical expertise to analyse the CCTV footage and autopsy results.”
“We urge the Ukrainian authorities to undertake a thorough investigation into Ihor Indilo’s death, which must resolve these unanswered questions.”
