응웬 번 하이(Nguyen Van Hai)와 다른 블로거 2명이 20년 까지 형을 받게 됐다.
2012년 9월 24일 월요일, 호치민(Ho Chi Minh)시 인민 법원에서 열리는 재판에 앞서 국제앰네스티는 표현의 자유에 대한 권리를 행사한 이유로 20년 형까지 처할 수 있는 베트남 블로거 3명을 즉각, 조건 없이 석방해야 한다고 밝혔다.
이 재판은 베트남당국이 표현의 자유와 평화적 집회를 계속해서 단속하던 중에 일어났다.
“베트남당국은 표현의 자유를 존중하는 베트남 헌법과 국제적 의무를 반드시 준수해야 한다”고 루퍼트 애버트(Rupert Abbott) 국제앰네스티 베트남조사관은 말했다.
또한 “그 블로거들은 온라인을 통해 표현의 자유를 평화적으로 행사했다는 이유로 구금된 된 양심수들이며, 반드시 석방되어야 한다”고 덧붙였다.
구금된 블로거들은 디우 꺼이(Dieu Cay, 농부의 파이프)로 알려진 응웬 번 하이, ‘정의와 진실(Justice and Truth)’ 블로그 주인인 전 여경출신의 타 퐁 탄(Ta Phong Tan), 안바싸이곤(AnhbasaiGon)으로 알려진 판 탄 하이(PhanThanhHai)다. 그들은 베트남 형사법 제88조에 따라 반정부 선전을 하였다는 죄목으로 기소되었는데, 20년까지 형을 받을 수 있다.
블로거 3명 모두 오랫동안 미결구금 당한 상태이다. 재판은 원래 올해 4월 17일에 열리기로 되어있었으나, 지금까지 3번이나 연기되었다. 마지막으로 재판이 연기된 날은 지난 7월 20일이었다. 당 티 김 리엥(Dang Thi Kim Lieng, 타 퐁 탄의 어머니)은 딸에 대한 정부의 처우에 항의하기 위해 정부건물 밖에서 분신자살했다.
국제앰네스티는 베트남당국이 정부정책에 대해 비판적이고, 더 큰 자유를 옹호하는 블로거들의 가족들과 친구들을 억압하고 위협한다는 보고를 많이 접했다.
9월 16일 경찰은 느구옌 반 바이의 아내 뒁 띠 탄(Duong Thi Tan), 타 퐁 탄의 자매 타 코이 풍(Ta KhoiPhung), 안토니 리 느곡 탄(Anthony Le Ngoc Thanh) 가톨릭 신부, 민주주의와 토지권리(Land rights) 활동가인 루 띠 뚜 트랑(Lu Thi Thu Trang)을 포함한 6명을 체포했다.
이들은 당 티 김 리엥의 특별한 장례식을 치르기 위해, 박류(Bac Lieu)주 남부에 있는 그의 집에 모였다. 전해진 바로는 장례식이 끝나고 택시를 기다리고 있을 때, 베트남당국은 그들을 체포할 구실로 오토바이 사고를 조작했다. 경찰은 그들 모두를 구타한 뒤, 당일 날 풀어 주었다.
애버트 베트남조사관은 “타 퐁 탄의 어머니 장례식에 참석한 사람들을 체포하고 구타함으로써, 베트남 당국이 또 한번 최하의 인권수준을 보여주었다”고 전했다.
더불어 “블로거3명은 반드시 석방되어야 하며 블로거들의 가족들과 친구들에 대한 수치스러운 억압이 중단되어야 한다”고 덧붙였다.
Viet Nam: Release bloggers, stop harassing their family and friends
Nguyen Van Hai (“Dieu Cay”) and two other Vietnamese bloggers face up to 20 years in jail.
Three Vietnamese bloggers who face up to 20 years in jail simply for exercising their right to freedom of expression should be released immediately and unconditionally, Amnesty International said today, ahead of their trial at Ho Chi Minh City’s People’s Court on Monday 24 September 2012.
Their trial comes as the Vietnamese authorities continue to crack down on freedom of expression and peaceful assembly.
“The Vietnamese authorities must abide by their constitutional and international obligations to respect the Vietnamese people’s right to freedom of expression”, said Rupert Abbott, Amnesty International’s Researcher on Viet Nam.
“The bloggers are prisoners of conscience, detained solely for the peaceful exercise of their right to freedom of expression through their online writings, and must be freed”.
The bloggers are Nguyen Van Hai, known as Dieu Cay (“the peasant’s pipe”); former policewoman Ta Phong Tan, whose blog is called “Justice and Truth”; and PhanThanhHai, known as AnhBaSaiGon. They are accused of conducting anti-state propaganda under Article 88 of Viet Nam’s Criminal Code – offences that carry sentences of up to two decades.
The three bloggers have all been held in lengthy pre-trial detention. Their trial was originally due to be held on 17 April this year, but has been delayed three times; last time when Ta Phong Tan’s mother, Dang Thi Kim Lieng, died after setting herself on fire outside government buildings on 30 July 2012 to protest the treatment of her daughter.
Amnesty International has received numerous reports about the Vietnamese authorities harassing and intimidating the family members and friends of those who criticise government policies and advocate greater freedoms.
Last week, on 16 September, police arrested six individuals including Nguyen Van Hai’s wife, Duong Thi Tan; Ta Phong Tan’s sister, Ta KhoiPhung; Catholic priest Father Anthony Le Ngoc Thanh; and democracy and land rights activist Lu Thi Thu Trang.
The group had gathered at the home of Ta Phong Tan’s mother, Dang Thi Kim Lieng, in southern Bac Lieu province, for a special ceremony to commemorate her death. As they waited for a taxi after the ceremony, the authorities allegedly orchestrated a motorbike accident as a pretext for detaining them. Police beat all of them, but released them later that day.
“By detaining and beating mourners commemorating the death of blogger Ta Phong Tan’s mother, the Vietnamese authorities have reached another low”, said Abbott.
“The three bloggers must be released, and the shameful harassment of their families and friends must end, with those responsible held accountable”, he said.
